How it works
Oman's 2023 Labour Law uses two different wages at the end of a job, and the settlement keeps them apart. The gratuity under Article 61 is calculated on the final basic wage - the contract pay plus periodic increments. Unused annual leave is paid on exit at the gross wage, basic plus all allowances, under the last paragraph of Article 81, even though buying leave out during the job is at the basic wage. Article 38 requires thirty days' notice for monthly-paid workers on open-ended contracts (fifteen for others) and pays notice not given at the last gross wage. Article 1 defines a month as thirty days, so day values divide by thirty. Article 91 makes all dues payable immediately when the job ends, or within seven days if the worker left of their own accord, and Article 96 lets government and employer dues be deducted from the gratuity.
Calculation method
- Gratuity: Art. 61 on the final basic wage
- Unused leave = gross / 30 x days (Art. 81)
- Notice in lieu = gross / 30 x 30 days (Art. 38)
- Due within 7 days of the end (Art. 91)

Limitations
- For non-Omani workers; Omanis have no employer gratuity.
- Compensation for arbitrary dismissal (3 to 12 months, Art. 11) is not added.

Questions
What is the notice period in Oman?
30 days for monthly-paid workers and 15 days for others on open-ended contracts, unless the contract sets more (Labour Law Article 38). Pay in lieu is at the last gross wage.
Is unused leave paid at basic or gross wage in Oman?
At the gross wage when the job ends (Article 81). Buying leave out during employment is at the basic wage, with the worker's written consent.
When must the final settlement be paid in Oman?
Immediately when the employment ends, or within 7 days if the worker left voluntarily (Article 91).
Can I resign without notice and keep my gratuity in Oman?
Yes, in five cases listed in Article 41 - for example when wages have gone unpaid for more than two consecutive months - the worker may leave without notice and keep all entitlements.
Do I get time off to look for a new job during notice in Oman?
Yes. Article 39 gives ten paid hours a week to look for work during the notice period.

| Who the gratuity applies to Omanis are insured in the Social Protection Law old-age branch and get no employer gratuity (accrued pre-2024 social insurance gratuity is a fund benefit, Art. 159). The savings system (9% of basic, employer-paid, Art. 139(1)) replaces the non-Omani gratuity from a date the Fund Board sets, no later than 19 Jul 2027; no Board decision had been published by 7 Oct 2026. GCC nationals working in Oman are not covered by this widget (unresolved). |
