How it works

Royal Decree 53 of 2023, in force from 31 July 2023, rewrote Oman's labour law. Article 61 obliges the employer, when the employment of a worker not covered by the Social Protection Law ends, to pay a gratuity of not less than «أجر أساسي» - a basic wage - for each year of service, fractions in proportion, on the worker's final basic wage, and service before 2023 counts. In practice that means expatriates: Omanis are insured under the Social Protection Fund's old-age branch and receive no employer gratuity. The old 2003 law said 'fifteen days' wage for the first three years and a month after'; the new text says only 'a basic wage', which for a monthly-paid worker A2Z reads as one month's basic wage - the widget states that reading. There is no minimum service and no reduction on resignation, but dismissal for one of the nine grounds in Article 40 forfeits it. Article 61 applies until the Fund's savings system starts - at the latest 19 July 2027 - after which the employer pays 9% of basic wage into savings instead, and service up to that date is settled under Article 61.

Limitations

  • Non-Omani private-sector workers; GCC nationals are not covered (unresolved).
  • The one-month reading of "a basic wage" is an interpretation of the Arabic text.
  • Employer savings plans approved under Article 48 that replace the gratuity are not modelled.

Questions

How is end of service calculated in Oman?

Under Labour Law Article 61 (RD 53/2023), a non-Omani worker receives at least a basic wage for each year of service, pro rata, on the final basic wage. Four years on OMR 350 basic gives OMR 1,400.

Do Omanis get an end-of-service gratuity?

Not from the employer. Omanis are insured under the Social Protection Fund's old-age, disability and death branch; Article 61 covers workers outside that law.

What is the Oman savings scheme?

Under Social Protection Law Article 139, the employer will pay 9% of a non-Omani worker's basic wage each month into a savings fund that replaces the gratuity. The Fund's board sets the start date, at the latest 19 July 2027; until then Article 61 applies.

Is there a minimum service for gratuity in Oman?

No. The 2023 law sets no minimum; part years count in proportion.

Why does the calculator say 'a basic wage'?

The Arabic text says «أجر أساسي عن كل عام», not «أجر شهر». For a monthly-paid worker that is read as one month's basic wage; the old 2003 law used different wording.

Who the gratuity applies to
Omanis are insured in the Social Protection Law old-age branch and get no employer gratuity (accrued pre-2024 social insurance gratuity is a fund benefit, Art. 159). The savings system (9% of basic, employer-paid, Art. 139(1)) replaces the non-Omani gratuity from a date the Fund Board sets, no later than 19 Jul 2027; no Board decision had been published by 7 Oct 2026. GCC nationals working in Oman are not covered by this widget (unresolved).
