Kuwait Final Settlement Calculator Widget
Put together a Kuwait final settlement line by line: wages still owed, the Article 51 indemnity, cash for accumulated annual leave under Article 73, and pay in lieu of the three months' notice that Article 44 requires for monthly-paid workers - whichever side owes it.

How it works
Each entitlement keeps its own row and legal basis. The indemnity follows Articles 51 to 53 on the last wage, with the same engine as A2Z's Kuwait indemnity calculator, including the Article 53 fractions on resignation. Article 73 pays accumulated annual leave in cash when the contract ends; the day value is the wage divided by the working days you enter, the method the Law states in Article 67. On an open-ended contract Article 44 requires at least three months' notice for monthly-paid workers and one month for others; whoever skips it pays the worker's wage for the notice period, so the widget counts three months when notice is owed and you leave the days blank, or the days you enter. Wages still owed, contractual extras and debts are taken as entered - Article 51 allows the employer to deduct the worker's debts and loans. A court may add one per cent of unpaid dues for each month of delay under the amended Article 146.
Calculation method
- Indemnity: Arts. 51-53 on the last wage (with allowances)
- Accumulated leave = wage / working days x days (Art. 73)
- Notice in lieu = wage / 30 x 90 days for monthly-paid workers (Art. 44)
- Net = outstanding + indemnity + leave + notice to the worker + other - notice owed by the worker - debts
Worked examples
Ended by the employer after eight years
Inputs: Wage with allowances KWD 900; 10 leave days; notice paid in lieu
Result: Net KWD 8,342.308
5,296.154 + 346.154 + 2,700.
A calculation aid, not legal advice.
Limitations
- Monthly-paid workers only.
- Damages for arbitrary dismissal (Art. 41(c)) and the court's 1% a month are not added.
- Wages owed and debts are entered by you.
Where publishers use it
- An HR clearance sheet for a departing employee in Kuwait
- A worker checking the employer's settlement before signing the release
- A legal-aid page explaining the three-month notice rule
- A domestic-recruitment office or Shuwaikh Industrial firm closing out an expatriate contract
Questions
What is the notice period in Kuwait?
At least three months for monthly-paid workers and one month for others on open-ended contracts (Law 6/2010 Article 44). The party that does not give notice pays the worker's wage for the notice period.
Is unused annual leave paid when I leave Kuwait?
Yes. Article 73 entitles the worker to cash for accumulated annual leave when the contract ends; up to two years' leave can be accumulated (Article 72).
Can the employer deduct loans from my settlement?
Article 51 allows debts and loans the worker owes to be deducted from the indemnity; social-insurance contributions cannot be deducted.
What if my employer pays the settlement late?
Under the last paragraph Law 32/2016 added to Article 146, the court may order an extra 1% of the unpaid dues for each month of delay, counted from the worker's complaint to the labour department.

|---|---|---|---|---|
| End-of-service indemnity (monthly-paid) Monthly-paid workers: 15 days' wage for each of the first five years and one month's wage for each later year, part years pro rata, capped at one and a half years' wage, on the LAST wage (basic plus contractual allowances, Arts. 55, 62). Since Laws 85/2017 and 17/2018 (retroactive to the start of Law 6/2010) the employer may not deduct its social-insurance contributions. Workers' debts and loans are deducted. Daily, weekly, hourly and piece-rate workers have a different formula (10 / 15 days, cap one year) that this rule does not cover. The Law gives no figure for "a day's wage" in Art. 51; the only method it states is salary / actual working days excluding weekly rest days (Art. 67 para. 2, written for the rest-day article) - applying it here is an interpretation, so the widget shows the working days as an editable input (26 for a six-day week). No amendment of Arts. 41-53 or 64-73 after 2018 was found up to Feb 2024; 2024-2026 not confirmed. |

| Indemnity on resignation Resignation from an open-ended contract: half the indemnity from 3 to under 5 years, two thirds from 5 to under 10, the full indemnity from 10 years; nothing below 3 years (the article grants nothing below three years). Full indemnity whatever the service when the employer ends the contract, a fixed term expires, under Arts. 48-50, or when a woman resigns within a year of marriage (Art. 52). Dismissal under Art. 41(a) forfeits it; Art. 41(b) dismissal keeps it. 7 consecutive or 20 separate days of unexcused absence can be treated as resignation (Art. 42). |
