How it works

Law 85 of 2017 rewrote Article 70 from 9 July 2017: every worker is entitled to at least thirty working days of paid annual leave a year, and weekly rest days, official holidays and sick days falling inside the leave are not counted against it - so thirty working days is about five calendar weeks for a six-day week. The first year's leave is earned after six months of service, and fractions of a year count in proportion, including the first. The widget accrues the entitlement through the current leave year from the last work anniversary, adds days carried over - Article 72 allows up to two years to accumulate - and subtracts days taken. Article 73 pays accumulated leave in cash when the contract ends, and Article 74 forbids giving it up. The cash value uses the wage divided by twenty-six working days, an assumption for a six-day week shown with the result.

Questions

How much annual leave do workers get in Kuwait?

At least 30 working days of paid leave a year (Law 6/2010 Article 70 as amended by Law 85/2017). Weekly rest days, official holidays and sick days inside the leave do not count.

When can I take leave in my first year in Kuwait?

After six months of service; the 2017 amendment cut this from nine months.

Can I carry leave forward?

Up to two years' leave can be accumulated; more needs the agreement of both parties (Article 72).

Is leave pay given before I travel?

Yes. Article 71 requires the leave wage to be paid before the leave starts, and Article 74 makes any agreement to give up annual leave void.

Can my employer split my leave?

With the worker's consent leave can be split after the first fourteen days are taken together, and the employer sets the dates according to work needs (Article 72).

Do Eid and National Day fall inside my annual leave in Kuwait?

No. Since 2017 official holidays, weekly rest days and sick days that fall within the leave are added on rather than counted, so 30 working days of leave can stretch across five or six calendar weeks.

What did the 2017 amendment change for new joiners in Kuwait?

Law 85 of 2017 shortened the wait for first-year leave from nine to six months and made weekly rest days fall outside the leave count; before July 2017 the entitlement was thirty calendar days.
